1. Acceptance of these Terms
These Terms and Conditions govern your access to and use of the website, mobile app, tools, forms, resources, content, consultation booking flows, and online services operated by Immergity Immigration Inc.
2. Regulated immigration services
Immigration guidance and professional immigration consulting services are provided or reviewed by Pranav Bhushan, Regulated Canadian Immigration Consultant (RCIC), CICC #R705848, where applicable. The College of Immigration and Citizenship Consultants is the regulator for RCICs.
3. Informational tool only; not legal advice
The website and app are provided for general information, education, assessment, referral routing, and consultation-preparation purposes. They are not legal advice, not immigration advice specific to your case, not a substitute for an RCIC consultation, and not a guarantee of any immigration outcome.
Immigration law, policy, forms, processing times, government instructions, and program criteria can change. You should not rely on website content, app content, or tool results as the only basis for immigration, employment, travel, filing, or legal decisions.
4. No consultant-client relationship from website or app use
Using this website, using the app, submitting an assessment, requesting a referral, using a tool, or receiving automated results does not create a consultant-client relationship with Immergity Immigration Inc. or any representative.
A consultant-client relationship is created only when we expressly agree to provide professional services and the required consultation agreement, service agreement, retainer, authorization, consent, payment, or written engagement process has been completed.
5. Consultation agreements and service agreements
Before an initial paid or pro bono immigration consultation, we may require a written consultation agreement. Before professional immigration or citizenship consulting services are provided beyond an initial consultation, a written service agreement or equivalent engagement documentation may be required.
Professional services are subject to the specific scope, instructions, fees, disbursements, timelines, refund terms, confidentiality terms, complaint-handling information, and responsibilities set out in the applicable agreement or written communication. If there is a conflict between these website Terms and a signed service agreement, the signed service agreement governs the professional service.
6. Fees, invoices, receipts, and payments
Professional fees, consultation fees, app-related charges, digital purchases, subscriptions, government fees, disbursements, taxes, and other amounts are handled according to the applicable booking terms, invoice, receipt, service agreement, app-store terms, or written communication.
Invoices and receipts are issued according to applicable professional, legal, and tax requirements. If app-store billing, in-app purchases, or subscriptions are introduced, Apple, Google, or another app-store provider may control billing, cancellation, renewal, taxes, and refunds under their own terms.
7. Refund policy
Refund terms for professional services are governed by the applicable consultation agreement, service agreement, invoice, booking terms, or written communication. Unless a different written refund term applies, completed consultations and delivered professional services are not generally refundable.
Duplicate payments, billing errors, or payments received for services that we decline to provide may be refunded after review. Government fees, third-party fees, courier fees, translation fees, app-store charges, and other disbursements may be non-refundable once paid to the relevant third party.
8. No guarantees
Immergity does not guarantee approval, selection, invitation, nomination, admission to Canada, processing speed, reconsideration success, appeal success, work permit approval, permanent residence approval, referral acceptance, consultation availability, or any other immigration result.
9. Eligibility tools and automated outputs
Website tools, app tools, calculators, checkers, simulators, diagnostic engines, and eligibility assessments are designed to provide general guidance based on information entered by the user. Tool results do not confirm eligibility, admissibility, completeness, strategy, document sufficiency, approval prospects, or whether a person should file an application.
10. Your responsibilities
You agree to provide accurate, complete, and truthful information when using our website, app, tools, forms, consultations, or services. You must not submit false, misleading, unlawful, or unauthorized information. If you provide information about another person, you must have the legal authority, consent, or other lawful basis required to provide it.
11. App data deletion
The Immergity app is currently planned without user account creation. To request deletion of assessment data, referral request data, or related app data, email privacy@immergity.ca with the email address or phone number used in the assessment or referral request and state that you are requesting deletion of assessment data.
12. Third-party processors and services
This website and app may link to or rely on government websites, immigration resources, Supabase, Google Firebase/Firestore, analytics providers, third-party tools, payment processors, booking platforms, app stores, social media sites, and other external services. We do not control and are not responsible for third-party content, availability, accuracy, security, privacy practices, accessibility, or terms.
13. Privacy
Your use of this website, app, and tools is also governed by our Privacy Policy, which explains how personal information may be collected, used, disclosed, retained, protected, and deleted.
14. Website and app availability
We try to keep the website and app available and accurate, but we do not warrant that either will be uninterrupted, error-free, secure, current, complete, or free of harmful components. We may update, remove, restrict, suspend, or discontinue any part of the website, app, tools, or content at any time.
15. Limitation of liability
To the maximum extent permitted by law, Immergity Immigration Inc., its directors, officers, employees, contractors, representatives, and service providers are not liable for any direct, indirect, incidental, consequential, special, punitive, or other damages arising from or related to your use of, or inability to use, this website, app, content, tools, third-party links, online resources, assessments, referral requests, or automated results.
This limitation does not limit liability that cannot be excluded under applicable law or obligations that arise under a signed professional services agreement where such limitation is not legally permitted.
16. Intellectual property
All website content, app content, text, layout, branding, graphics, tools, guides, code, workflows, and other materials are owned by or licensed to Immergity unless otherwise stated. You may view and use them for personal, non-commercial purposes.
17. Governing law
These Terms are governed by the laws of Ontario and the applicable federal laws of Canada. Any dispute related to these Terms, the website, or the app will be handled in the courts or tribunals with jurisdiction in Ontario, unless applicable law requires otherwise.
18. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. Continued use of the website, app, or services after changes are posted means you accept the updated Terms, where legally permitted.
